The invoice serves as the contract. Upon receiving a deposit, it signifies acceptance of our terms and conditions (https://www.nanasgelato.ca/terms).

DAY OF COORDINATION

​

• The gelato cart/tabletop display will be set up approximately 1 hour before the event.

• Any changes to the Day of Coordination will be communicated to Nana's Gelato Cart on time.

 

LOGISTICS

 

The Client must confirm with the venue the following details. Any issues may result in delays.

• The vintage gelato cart will need a clear path (no stairs) to the setup location.

• Door width of 42”

• Access to a dedicated electrical outlet.

 

CANCELLATION POLICY

 

All prepayments and deposits will be returned in the form of a credit if the event is cancelled by the Client, 90 days or more from the event date. If the event is cancelled within 90 days of the event date, all prepayments and deposits will be returned in the form of a credit (minus cancellation fee $100) of the deposit amount.  If the event is cancelled within 60 days of the event, all deposits and prepayments are forfeited.  

 

Nana's Gelato reserves the right to terminate this contract for any reason.  If the Nana's Gelato terminates this contract any time up to 30 days prior to the event date, all deposits and prepayments will be returned in full within 10 days. If the Nana's Gelato terminates this contract within 30 days prior to the event date, all deposits and prepayments will be returned in full within 10 days as well as an additional $100 as penalty.

 

INTELLECTUAL PROPERTY RIGHTS

 

All photos taken by Nana's Gelato team during the time of the event will remain the intellectual property of Nana's Gelato.

 

DAMAGE

 

Nana's Gelato assumes no responsibility for any damage or loss of any merchandise, equipment, furniture, clothing, or other valuables prior to, during or after the event. 

 

INDEMNIFICATION AND LIABILITY

 

Nana's Gelato and Client agree to indemnify and hold each other harmless from any damages, losses, or liabilities.

 

LIABILITY     

 

Client absolves Nana's Gelato from any third-party claims, except for actions caused by Nana's Gelato and/or the negligent conduce of its employees. Claim cannot exceed value of contract.

 

THIRD PARTY LIABILITY

 

Nana's Gelato assumes no responsibility for the conduct of guests, members and/or third parties hired to provide services.

 

INDEMNIFICATION   

 

Nana's Gelato will indemnify and hold the Client harmless from any claims against the Client by any other party, arising directly or indirectly out of the provision of the Services by the Provider. 

 

GOVERNING LAW AND JURISDICTION

 

This Agreement shall be governed by the laws of Ontario, Canada and any disputes shall be resolved in the courts of Ontario, Canada.
